Smoke Alarms in Queensland Rentals: The New Rules

Queensland has some of the strictest smoke alarm legislation in Australia. The transition to interconnected photoelectric alarms affects every rental property in Townsville.

What the Legislation Requires

Queensland's smoke alarm legislation requires interconnected photoelectric smoke alarms in all bedrooms, hallways connecting bedrooms to the rest of the dwelling, and on every storey of the property.

Interconnected means that when one alarm is triggered, all alarms in the property sound. This is a significant safety improvement over previous requirements. Photoelectric alarms are better at detecting slow, smouldering fires than ionisation alarms.

Landlord Obligations

Landlords are responsible for installing the required smoke alarms and ensuring they are in working order at the start of each tenancy. After the landlord's obligations are met, the tenant becomes responsible for testing the alarms and replacing batteries during the tenancy.

When a new tenancy begins, the landlord must test the alarms, replace batteries if needed, and record that this has been done.

Non-Compliance Consequences

Non-compliance with Queensland's smoke alarm legislation is a serious matter. Penalties apply to landlords who do not have the required alarms installed. In the event of a fire, a landlord who was not compliant faces significant legal and financial exposure.

Compliance is straightforward and the cost is manageable. There is no reason for any Queensland rental property to be non-compliant.
